My ex employer recently advised they have overpaid me. By law do I have to pay them back?

I recently received a letter from my ex-employer stating that they have overpaid me due to an error on their part. All the paperwork has been signed and finished I am wondering if by law I am required to pay them back? Or are they relying on my own good will?

  2. If they want it back, you have to give it back. You did not earn it.

    Yes, but I would get EVERYTHING in writing, including a receipt of your CHECK having paid them back. Do not pay them back in cash. There are taxes that are in that paycheck that need to be resettled, and so on.

  4. Yes, and you will likely pay it back by having it deducted from your next series of paychecks until the overpayment is covered.

    Given today’s date, I would add that you should watch the tax implications for both last year and this year very carefully…

    Yes you do…monies paid under mistake are entitled to be reclaimed. Make sure you double check your employment contract etc and ensure that you pay back the correct amount and you weren’t legistimately paid extra (ie; overtime they may not have been aware of etc). As much as this sucks, the lawis there for a reason - you wouldn’t like to accidently overpay someone and then not be able to have the money returned.
